试论消费者权益救济机制的重塑

美国现代法哲学家E·博登海默认为，秩序“意指在自然界与社会过程运转中存在着某种程度的一致性、连续性和确定性。”秩序的存在是人类一切活动的前提，创选与维护秩序，是法律产生和存在的基本价值，因此，我国的《消费者权益保护法》明确将“维护社会经济秩序”写进了立法宗旨，随着我国市场化改革的深化和成功加入WTO，消费者权益救济已经成为一个十分迫切的现实性课题，但由于种种原因，我国消费者权益救济机制还存在诸多问题，迫切需要从立法、司法、行政、社会等各个方面采取措施，迅速加以补救和完善。

The Reconstruction of Consumer Rights and Interests Relief Mechanism

American modem law philosopher Edgar Bodenheimer approves that ＂the order acts as some kind of uniformity, the continuity and the determinism in the nature and in the social evolution process.＂ The order existence is the precondition for all human beings activities. In addition, the creation and maintenance of order is the basic value for the enact of law. Therefore, our country has formally put ＂the maintenance of social economic order＂ into ＂Law of the People＇s Republic of China on Protection of Consumer Rights and Interests＂ in order to reach the legislation objective. With our deep market reform and successful participation of WTO, the consumer rights and interests relief already becomes one extremely urgent feasible topic. However, due to some reasons there are still many problems in consumer rights and interests relief mechanism in China. Therefore, it is in need of taking some measures to rapidly perform and recover the consummation in legislation, judicature and administration.
