中央推进粤港澳大湾区建设的法治路径--“中央权力行使指南”的提出

《粤港澳大湾区发展规划纲要》将"一国两制,依法办事"作为指导思想和基本原则,明确了中央以法治路径推进大湾区建设的理念。在以法治路径推进大湾区建设过程中,由于"一国两制"的实施,以及大湾区加快制度创新和先行先试的战略要求,中央权力易于出现两种倾向:一方面,中央权力易于越位,即突破宪法、基本法等法律,逾越中央与地方权力的界限;另一方面,中央权力易于缺位,即过分强调地方自主协作,忽视中央权力的重要作用。为了保障全面依法治国战略在大湾区建设中有效实施,做到中央权力不缺位、不越位,有必要结合大湾区建设所涉及的事项,根据地方推进该事项的意愿与权力,将这些事项分为四类,依据宪法法律针对性地提出"中央权力行使指南",明晰中央推进大湾区建设的法治路径。

How the Central Government Builds the Guangdong-Hong Kong-Macao Greater Bay Area in Accordance with Law

The Outline of the Development Plan for the Guangdong-Hong Kong-Macao Greater Bay Area regards "one country, two systems, and acting in accordance with the law" as the guiding ideology and basic principles. It requires that the construction of the Greater Bay Area must respect the rule of law, and act in strict accordance with the Constitution and the Basic Law. However, Central power is prone to two tendencies: on the one hand, central power is easily to violate laws such as the Constitution and the Basic Law;on the other hand, central power is easily overlooked. This article proposes that it is necessary to classify the matters involved in the construction of the Greater Bay Area into four categories, and to put forward a "Guide to the Exercise of Central Power" in accordance with the law.
