我国行政人员依法行政意识培育机制实证研究

依法行政是现代法治的主要内容。行政人员是一国行政活动的实施主体,考察其对“行政权本原及其目的”、“职权法定和权责统一”、“法律保留和法律优位”、“依据法律行政”、“依据程序行政”和“依法接受监督和承担法律责任”等现象的认知、关注、实践、评价和期待,不仅有助于准确判断我国依法行政的发展水平,而且有助于有效强化行政主体的依法行政意识。据此,本文实证性地研究了我国依法行政实践、行政人员依法行政意识和法制宣传教育三者之间的关系。

Positivist Research on Training Mechanism for Administrating in Conformity with Law by Chinese Administrators

Administrating in conformity with law is the main content of ruling the country by law. And administrators are the main body to perform administration. It is extremely vital to check their knowledge, concern, practice, evaluation and expectation of "the essence of administrative power and its purpose", "the power stipulated by law and the accordance of responsibility and power", "the priority of law", "administrating in conformity with law", "administrating following the procedure" and "being supervised by law and taking responsibility". It is helpful not only to judge the developmental level of our administrating in conformity with law, but also to reinforce their consciousness of administrating in conformity with law. Hence, this article positivistly studies the relation among practice of administrating in conformity with law, administrators' consciousness of administrating in conformity with law, and education of law.
