| 摘 要： | 反倾销法中的最佳可获信息规则(BIA)有其存在的合理性,但客观上对出口方不公平。WTO立法对BIA做出了指导性和原则性规定,WTO争端解决机构(DSB)的实践对该规则有所发展和引伸。欧美的BIA要求十分详细,适用条件明确,欧盟的规定在文字上更接近WTO。中国的BIA已有制度和实践基础,需要进一步完善。

| Abstract: | The rule of Best Information Available(BIA) in the antidumping law would objectively cause unjustness to exporters though the existence of the rule itself could be justified.The WTO system merely have instructionally provided for the BIA and the practice of DSB has developed and extended the rule.The rule of BIA in the west is prescribed specifically with explicit conditions of application,and the expression of regulation in the EU is more close to the rule in TWO system.Further improvement is still required for the BIA in China. |
