| 摘 要： | 代位申请执行是债权人保护自己权利的一项重要手段,但现行的司法解释对代位申请执行的规定比较简单,有些规定不尽合理。所以,有必要针对现行代位申请执行规定中存在的问题,在立法上加以修改和完善。
