| 摘 要： | 刑事和解作为在司法实践中一道亮丽的风景线,在新《刑事诉讼法》颁布后更是名正言顺了,包括《高法解释》、《高检解释》以及《公安部规定》在内的若干文件进一步丰富了刑事和解的内容。从实证角度出发,以《刑事诉讼法》法条为根本探讨侦查阶段刑事和解的现状,分析新法颁布后侦查阶段刑事和解的立法规定及其问题,以期对该制度更好的完善有所启示。

| Abstract: | Criminal reconciliation in judicial practice as a beautiful landscape, in the new “Code of Criminal Procedure” is justifiably enacted, including the supreme court explained, the supreme court judicial interpretation and the ministry of public security regulation further enrich the contents of certain documents in criminal reconciliation. From the empirical point of view, taking the“Criminal Procedure Law”as a fundamental, focused on the status of the investigation stage of criminal reconciliation, analyze the new law issued by the investigative stage of the criminal reconciliation legislation and issues in order to better improve the system have some revelations. |
