| 摘 要： | 20世纪上半叶,民族主义思潮已发展成当时中国诸多社会思潮中最有号召力且影响最广泛的一种思潮。它是中国人民的政治立场和文化选择,与近代中国法制变革互为表里,并制约着传统法制的现代化变革。守旧救国思潮并不是近代中国民族主义思潮的主流,代表其主流的是变革救国思潮。就发展大势而言,守旧救国思潮不断低落,日趋穷途末路,变革救国思潮日益高涨,不断加速推动着近代中国法制现代化的进程。

| Abstract: | Early in 20th century,the trend of nationalism became a most appealing and influential one among various social trends of China.As a political stand and cultural option of China,the trend of nationalism restricted the change of traditional legality modernization being outside and inside of the modern legality modernization.The conservative trend of saving the nation isn't considered as a main current,instead,the trend of changing and saving the nation represented the main one.As far as the general situation is concerned,the conservative trend of saving the nation is going down whereas the trend of changing and saving the nation is increasingly growing and promoting the course of legality modernization of modern China. |
