| 摘 要： | 犯罪要素应遵循裁判过程予以序化,形成由客观到主观的阶层递进模式,中国刑法犯罪构成体系可在借鉴大陆法系递进式犯罪论基础上,对通说＂四要件＂犯罪构成体系予以分解重构,使传统平行结构体系融入递进因素,以犯罪构成体系的变革推动刑法理论发展与司法改革实践。
