侦查学研究方法反思及其构建

一般认为,辩证唯物主义和历史唯物主义是侦查学研究的最基本方法,但其混淆了"侦查方法"和"侦查学研究方法",使侦查学难以实现根本上的独立性和创新性。侦查学研究方法论应包括的内容有:价值分析方法,即研究者根据自身所秉持的价值评判标准,从哲学思想、道德基础、基本理念等方面评价、分析法律制度及其学说;规范分析法,即通过对法律规范及其可能发挥的规范性功能进行比较和对照,确定法律实现规范人们行为的原理和过程,从而解决法律规范自身的一般机理问题;经验研究方法,即通过观察、交谈(语言交流)、感受、体验、内省等方式来获得对社会的感性认识,并在此基础上通过定性研究和定量研究来达到对社会的理性认识。

The Reflection and Construction of the Research Methods of Criminal Investigation

Dialectical materialism and historical materialism are generally considered to be the most basic methods of researching criminal investigation,while ＂detective methods＂and＂research methods of detection＂ are always confused,which makes it difficult for the theory of detection to achieve a fundamental independence and innovation.Research methodology of detection are as follows： the method of value analysis,namely the researchers evaluate and analyze the legal system and its doctrine from philosophy,moral foundation and basic concepts according to their own value criteria;the method of normative analysis,which is used to identify the principles and processes that the law regulates people＇s behavior to solve its own problems through contrast and comparison of legal norms and possible regulatory functions;the method of experience research,or a method of gaining perceptual knowledge of society through observation,conversation,feeling,experience and introspection,and on this basis,to achieve a rational knowledge of society through qualitative and quantitative research.
