| 摘 要： | 关于程序正义与实体正义的关系法学界及实务界一直有争议。传统上我国一直是重实体轻程序,这与法律应程序至上的原则不相符。我们决不能单纯照搬西方的唯程序论,更不能走重实体而轻程序的老路,要发展出一条适合自己的法治之路。

| Abstract: | The controversy about substantive fairness and procedural justice exises all along in the legal and practice fields.We always pays more attention to sustantive fairness and neglects procedural justice traditionaliy.It dos not match the principle that legal procedure is first.We shold not only use the west views simply,but also the old road of ourselves.The proper way of rule of law should to be developed. |
