| 摘 要： | 在社会主义市场经济中,个人财产都是劳动者通过劳动积累起来的,在社会生产中发挥物质生产条件的作用,而不再发挥资本的功能。被现代生产的规律和法律制度所决定,所谓个人财产仅仅是为个人管理而已,本质上已经具有社会所有的性质了。
