| 摘 要： | 中国汉代文帝和景帝刑制改革,以废除肉刑为中心,是中国法律史和文化史上的重大事件。其思想背景是“新道家”思想,即综合了儒家、法家、黄老、阴阳家等思想因素,具有深厚的中华文化底蕴,是中国法律儒家化的先声和最重要的过渡基础;它在中国法律制度史、中国法律思想史乃至人类法律文明史上都具有重大历史意义。

| Abstract: | The WenJing Emperors' punishment system reformation in Han Dynasty,which concentrated on the abolishment of corporal punishment,is regarded as one of the significant events in China's legal and cultural history.The ideological origin of that was the new Taoism which integrates the thoughts of Confucianism,Hanfeizi's,Huangdi's,Laozi's and Zouyan's ideology.Drawing from the profound Chinese classic culture,the new Taoism foresaw the history of taking Confucianism into the legal system and underpins the most important transition in China's legal history.This legal system reformation has great historical significance throughout Chinese legal ideological history,legal system history and legal civilized history as well. |
