| 摘 要： | 公安行政处罚是公安行政执法的重要手段,也是社会关注的热点问题:在公安执法实践中,要确保行政处罚客观、公正、公开,须做到“三量而裁”。一量行政处罚相对人的行为是否违法;二量行政处罚相对人自身经济的承受能力及其行为发生地当时的经济环境;三量相对人对其违法行为后果的认识程度及教育转化难度。

| Abstract: | The administrative penalty of police is an important method of legal enforcement, as well as a hot issue in society. In practice, in order to guarantee its openness, fairness and subjectivity, the following should be considered: 1, the legality of counterpart's deeds; 2, the economic capacity of counterpart and the local economic environment; 3, the counterpart's recognition of his illegal deeds. |
