法律援助制度与弱势群体的人权保障

中国社会目前存在着一个庞大的弱势群体。由于生理或社会的原因,这个群体在整个社会生活中的诸多方面处于不利地位。法律对每位公民人权的保护都是平等的,当公民的合法权益受到侵害时,每位公民都可通过法律赋予的诉权,通过诉讼的方式寻求司法救济。然而,社会弱势群体由于自身的弱势,只能依靠国家的法律援助实现自己的诉权,维护自身的合法权益。法律援助制度作为国家法律制度的重要组成部分,还有待进一步完善。

Legal Assistance System and Guarantee of Human Rights for the Weak Multitude

At present there exists a great weak multitude in China. As a physiological or social result, their social life is in an unfavorable condition in many terms. Every citizen enjoys human rights under equal legal protection. When their legitimate rights and interests are damaged, they can seek for judicial relief by means of lawsuit-the accusation right bestowed by laws. Nevertheless, the right of the weak social multitude can only be fulfilled with the legal assistance of state because of their weakness,and the same is true to their safeguard of their own legitimate rights and interests. As one of the most important elements of the legal system of a state, the legal assistance system remains to be further perfected.
