当代中国民事习惯法研究的回顾与展望

当代中国民事习惯法研究已经取得了丰硕的成果；目前则必须向更深的研究领域和更高的研究阶段发展。通过历史与现代、理论与实际、立法与司法三方面的回顾，我们发现当代中国民事习惯法研究的发展在于：当代民事习惯法的研究，研究的专门化、精细化以及立法与司法的同步三方面。民事习惯法受到关注代表了对我国民事法律制度发展路径选择的反思，而这些进一步的研究在解决实际问题的同时，也为中国法治的发展提供了其“本土意义”。

Retrospect and prospect to the research of the civil costmary law in contemporary China

The research of civil customary law in contemporary China has yielded many achievements; now it must develop to the deeper areas and higher stages. Through these three aspects： history and nowadays, theory and practice, legislation and justice, we find that the development of the research to contemporary Chinese civil customary law consists in such three aspects as： contemporary civil customary law＇s research, the specialization and refinement of the research, and the hold-in between legislation and justice. The concern to civil customary law represents the confession of choosing the path which the development of China＇ s civil law went through. Furthermore, solving practical problems simultaneously, these researches also provide a kind of ＂local significance＂ to the development of rule-of-law in China.
