| 摘 要： | 知识产权是一种竞争性资源要素,拥有知识产权的程度决定着一个国家或企业在全球化经济中进行资源配置和国际分工时的地位。运用知识产权法律保护制度,充分维护自身的合法权益,获得和保持竞争优势并遏制竞争对手,谋求最佳的经济效益。我国实施知识产权战略的基础条件、文化观念、法制环境等与欧美、日本等经济发达国家相比有较大差距,因此在相关制度的选择与政策安排上必须具有独特性和针对性。

| Abstract: | Intellectual property right (IPR) is a resource factor in competition, and its ownership determines a state's or an enterprise's position in the resource allocation and the international division of labor in the process of economic globalization. It is very proper to use the IPR legalsystem to safeguard our legal rights, maintain superiority in competition, hold the competitors in check and pursue the maximal economic benefits. The key conditions, cultural conceptsand legal systems for carrying out the IPR strategies of China are quite different from those of the developed countries in Europe, America or Japan in Asia. Thus, the choice of the relevant systems and policies should have China's traits and clearaims. |
