| 摘 要： | 附条件不起诉作为一项新兴的刑事诉讼制度,在提高诉讼效率、节约司法资源、恢复受损社会关系方面取得了一定效果,也引起了我国刑事司法学界的广泛关注。文章阐释了该制度赖以存在的理论基础,表明了该制度存在的独特价值,并提出完善该制度的构想。

| Abstract: | Conditional non-prosecution,as a new criminal litigation system,has achieved some effects in improving litigation efficiency,saving judicial resources,and restoring damaged social relations,and also caused widespread concern in the field of criminal justice in China.The article illustrates the theoretical basis of that system,indicates the unique value of that system,and provides the conception of perfecting the system. |
