| 摘 要： | 法律与道德在规范层面上和事实层面上既有联系又有区别。＂小悦悦事件＂折射出整个社会群体道德责任感的缺失,但是一旦为道德立法,法的确定性和可预见性就会受到损害。见死不救是道德问题,不是法律问题。见死不救不能入刑。

| Abstract: | There are connections and differences between law and ethics in both specification level and fact level."The event of little Yueyue" reflects the lack of moral responsibility of entire social groups.However,if ethics is put into legislation,the certainty and predictability of laws will be damaged.Indifference is an ethical issue,not legal issue.Indifference cannot be put into criminal law. |
