| 摘 要： | 《民事诉讼法》和司法解释对其他法院管辖案件后财产保全如何处理未作出具体规定,给司法实践带来了极大的混乱。因法律规定的有权作出诉前财产保全和诉中财产保全的法院不同,对这两种保全措施须进行不同处理。目前,应尽快出台司法解释对这一问题作出具体的、可操作性强的规定,并修订《关于适用〈中华人民共和国民事诉讼法〉若干问题的意见》第108条规定。
