诉讼时效：物上请求权的“塔尔塔罗斯”

学界对物上请求权是否适用诉讼时效的规定向来争论颇多,同时各国立法例在这个问题上也是异彩纷呈,没有＂一同天下之义＂。不同的物上请求权观念将会导致不同的物上请求权与诉讼时效关系理论。因此通过对各种物上请求权性质学说的分析,进而分析各种物上请求权与诉讼时效关系立法理论与立法例,从而将物上请求权性质理论和物上请求权与诉讼时效关系理论在逻辑上予以连接,进而提出并论证＂诉讼时效应当是物上请求权的‘塔尔塔罗斯’＂（即诉讼时效应当扮演物上请求权终结者的角色）的观点具有理论与实务上之意义。

Limitation:the “Tartarus” of the right of claiming on property

There is no determined solution in academia for the question whether the right of claiming on property is regulated by the Limitation or not.As a result of different theories about the concept of the right of claiming on property,there are different answers for the problem.So,based on the analysis of the theories of the concept of the right of claiming on property,we can analyze the relationship between Limitation and he right of claiming on property in order to obtain the conclusion that Limitation is"Tartarus" of the right of claiming on property(that is,he right of claiming on property is regulated thoroughly by the Limitation).
