| 摘 要： | 单位自首在我国现行《刑法》中缺乏明确的规定,导致理论界对单位自首的成立与否存在两种对立的观点。本文拟在单位自首得以成立之基础上就单位自首认定中的两个难题进行探讨。

| Abstract: | Voluntary surrender of a unit has not been prescribed specificly in the current criminal law of our country,which leads to two different opinions on theory about whether voluntary surrender of a unit esists or not.On the basis of the situation that voluntary surrender of a unit come into existence,this article concentrates on two problems in the practice:the subject and validity of the voluntary surrender of a unit. |
