论ADR在中国乡土社会的制度设想及其实现

中国是一个农民占多数的国家,中国的问题主要是农村的问题,中国社会的现代化最重要的任务之一就是农村社会的现代化,中国法治建设遭遇的最大困难也在农村.现代城市社会维持秩序的规范是法律,而乡村社会秩序的维持,在很多方面,起作用的是礼.在众多纠纷解决方式之中,非诉讼纠纷解决机制(ADR)正是符合乡村社会解决纠纷要求的理想方式之一.中国法制要摆脱在乡土社会的尴尬境地,提供在乡村中适时对路的法律产品,凸显诉讼功能,加强法治,解决国家法与民间法的冲突,就必须建立多元纠纷解决机制.
