关于检察机关提起公益诉讼的制度构建

随着我国社会主义市场经济的发展和社会利益主体的多元化，在民事活动领域，公共利益得不到有效保护的问题逐渐凸显，关于建立民事公益诉讼制度的呼声也日渐高涨。通过对公益诉讼的理论分析，探讨检察机关提起公益诉讼的可行性，并提出我国建立公益诉讼的制度框架。

As the development of the socialist market economic and the diversification of the main interests of the community, the problem that the public interests in civil activities can not be availably protected are coming, and the clamor for the establishment of a civil public interest litigation is rising. Making an analysis on the theory fundament of public interest litigation, it probes the feasibility of presenting civil action by the prosecutorial organization, and presents the basic structure of our country＇s system.
