| 摘 要： | 多年来我国理论界对无效行政行为问题一直未引起充分重视，目前立法对无效行政行为与可撤销行政行为也来作具体区分。我国立法现状和不区分无效行政行为、可撤销行政行为存在弊端，建立我国无效行政行为制度是立法急需解决的问题。
