论死刑废止过渡期的刑罚阶梯

死刑走向废止是历史发展的必然,但是,从我国现实情况看,我国现行刑罚阶梯仍需保留死刑.我国现正处于死刑废止的过渡期,从死刑顺利走向废止的角度看,我国现行刑罚阶梯还存在着诸多弊端,因此,我国应对现行刑罚阶梯进行重构,并对刑罚阶梯中的死刑、无期徒刑和有期徒等刑种进行修改和完善.笔者认为我国死刑废止过渡期的刑罚阶梯应构建为:罚金、拘役、有期徒刑、无期徒刑、死缓和死刑六种.

Now, Our country is being in the transitional period of abolishing the death penalty. But there are many defects in the ladder composed of types of punishments of our criminal code now. We must reconstruct the ladder composed of types of punishments of our criminal code. After reconstructing, the ladder composed of types of punishments of our crimininal code should be: fines, criminal detention, fixed-term imprisonment, life imprisonment, the death penalty with a suspension of execution and the death penalty.
