和平时期军人生命权保护的法学分析

生命权是人权的基本权利之一,具有不可剥夺性。随着现代社会对人权保障的重视,军人这一特殊群体的生命权保护也引起了越来越多的重视。军人是穿着军服的公民,他们在生命权问题上具有理论的合理性,却不具有实际中的合法性。不论是从宪法、国防法还是纪律条令等法律规范中,都鲜见明确保护其生命权的字样。在军人生命权的保护中还存在一些困境,需要我们加以反思并改进。

Legal Analysis of Protecting Soldier's Right to Life in Peacetime

The right to life is one of the basic rights of human right, which is inalienable. With people putting more emphasis on the protection of human right, the protection to the right to life of soldier has caused more and more attention. Soldiers are citizens in uniform and they have theoretical rationality on the right to life and do not have legality in practice. Hardly can we find specific words on the protection of the right to life of soldiers in the constitution, the national defense law and disciplinary regulations and so on. There are still some dilemmas in the protection of the right to life of soldiers,which needs reftecting and improving.
