南京国民政府前期教育立法的宏观考察

摘    要:从1927年至1937年,南京国民政府进行了一系列教育立法,试图将教育机构的组织、教育活动、教育管理等纳入法律调整的范围。本文中,笔者试图将南京国民政府此期的教育立法放到近代中西方教育法制建设的历史发展中进行考察,通过比较研究的方法,从宏观上对南京国民政府教育立法的动因、教育法规体系、教育法的原则等方面进行考察。

Abstract:From 1927 to 1937,the Republic of China has witnessed a great many changes in the legislature as to the education,the educational institutions,ranging form the organization to various activities and educational administration. The thesis,based upon a comparative approach,and from a historical perspectives,observes the motivation of legislation on the education,the system of the educational law-making,and the principles underlying the educational law,and a comprehensive evaluation of the whole set of the educational law-making,with the intent of placing the educational law -making between 1927 to 1937 in the Republic of China into the position of the historical continuum of the educational legislation form foreign domestic,so as to gain a resourceful insight into the educational law-making mechanism in that period of time.
