| 摘 要： | 强制拆迁在近些年来引发了社会矛盾，究其根本，在于其所依据的《城市房屋拆迁管理条例》涉嫌“违宪违法”。建议废除目前的《城市房屋拆迁管理条例》，由全国人民代表大会制定《中华人民共和国拆迁法》，区分公益拆迁与商业拆迁，明确强制拆迁的概念、内容，设计切实可行的拆迁程序。
