| 摘 要： | 国际组织的职能性豁免是随着联合国的建立而确立起来的。国际组织豁免是一种职能性豁免，意味着国际组织职员只有在从事公务行为时才享有豁免权。职能必要是判断公务行为与非公务行为的主要标准。在卡恩案中，卡恩的行为纯属私人事务，与公务职能无关，故不受豁免的保护。

| Abstract: | The functional immunity of international organizations (IOs) is established along with the birth of the United Nations. The immunity of IOs is functional. It means that the IOs employees are protected by their immunity only when they behave the official acts. The functional necessity is the main standard to tell the official acts and non-official acts. The Managing Director Dominique Strauss-Kahn of IMF is not protected by his immunity because of his private visit to New York City and private business which is not official acts at all. |
