| 摘 要： | 精神赔偿首先出现在民事法律制度中，但国家侵权行为也会给受害人带来精神痛苦。完善国家赔偿制度中精神损害赔偿，体现了宪法的基本精神。构建赔偿制度要在遵循一定原则下，确立赔偿范围和数额。

| Abstract: | Viewing from the enforcement of the Law of National Restitution, there are quite full of loopholes in the legislation concerned. Public opinion makes a demand to revise the Law of National Restitution in present, especially to focus on the compensation for spiritual damages. It is a difficult issue for the law world to eonstrnct the system of the compensation for spiritual damages and to establish the principles and range of compensation in practice. |
