报应刑,教育刑及与犯罪的斗争

报应刑是以犯罪者的个人责任为前提、为基础的 ,其理论核心是着眼于犯罪的客观行为 ,而不论实施犯罪者的个人情况。教育刑理论为现代派理论 ,它认为犯罪的原因来源于个人与社会两个方面。当前国际社会已从报应刑过渡到教育刑 ,在走向崇奉社会防卫论的时代时 ,我们也应关切刑事政策、社会政策 ,力求最科学、最合理地适应社会发展的规律、历史进步的要求。

Contemporary penalty theory in the world has transited to modern education penalty from retribution penalty. China has an obvious gap with the international society in the respect of penal policy and social policy. In order to secure the smooth development of the policy of opening to the world, to realize legal equality and legal justice , to build a socialist country run by law, penal theory, penal policy and social policy must be further reformed.
