论司法之有限理性

司法是人类理性的一项制度设计 ,但在实际的司法运作过程中司法的这种理性是存在局限性的 ,主要体现在认定事实、适用法律、运用程序三方面。走向司法公正需要司法工作者在这三方面不断超越 ,也需要民众破除司法理性神话。

On the Limitation of Rationality of Judicature

Judicature is a system design of human rationality. However, in the operation of judicature, such a rationality is limited in the respects of determining the facts, applying the governing law and employing the procedures. In order to make judicature impartial, the judicial officials must spare no efforts in these three respects and the public must get rid of such a judicial rationality.
