| 摘 要： | 根据语言学和其他相关学科的基本理论 ,应当对法律语言学的研究内容进行清理 ,明确地排除目前常见于法律语言学论著的两个方面的内容 :一是虽然使用于法律领域但不发生变异、不具有使用特点的民族共同语的通用语料 ;二是法律语料的个性中已被民族共同语吸纳为共性的那些成分。法律语言学必须研究以下三个方面的内容 :1 法律语料的个性特点 ;2 通用语料在法律领域的使用特点 ;3 法律语境及其对语言运用的制约。

| Abstract: | According to the fundamental theory of linguistics and the other relevant subjects, the research content of linguistics should be cleared. Two aspects in linguistics' papers nowadays should be eliminated undoubtedly; firstly, ordinary materials of national common language applied in legal sphere but no variations and no practical characteristics; secondly, legal language materials whose individual characteristics have been incorporated into the national common language characteristics. Research on legal linguistics must revolve around the following three aspects: 1. individual characteristics of legal language materials; 2. practical characteristics of common language materials in legal sphere; 3. legal context and its restriction to the application of language. |
