WTO体制的基本原则与我国《外贸法》

WTO体制的基本原则主要有非歧视原则 ,关税减让原则、取消数量限制原则、促进公平竞争原则、对发展中国家予以照顾原则、透明度原则和允许例外与实施保障措施原则。《外贸法》在制定的目的和基础、调整对象、非歧视原则、公平竞争原则、透明度原则、市场开放原则和主要制度方面与WTO体制是一致的 ;但在对外贸易经营主体、外贸经营许可制、运用关税保护国内市场和保障措施规定等方面与WTO的规定有差距。

Basic Principles of WTO System and Chinese Law of Foreign Trade

Basic principles of WTO system are as follows: non-discrimination, reduction of tariff, abolition of quotas, promotion of fair competition, making allowances for the developing countries, transparency, permission of exception and exercise of securing measures. "Law of Foreign Trade" is consistent to WTO system in the respect of the purpose and basis of formulation, the object of regulation, the principle of non-discrimination, the principle of fair competition, the principle of transparency, the principle of opening the market, and main systems. However, they are different in the respect of foreign trade subject, the system of foreign trade license, the protection of domestic market by applying tariff and the provisions of securing measures.
