| 摘 要： | 辩诉交易制度是发源于美国的一种快速结案诉讼制度 ,有其内在的合理性。其中的控辩量刑交易制度 ,可为我国法律移植与借鉴 ,但应严格程序规范以保障其实施的正确与尊严 ;其中的定罪辩诉交易制度 ,无论从诉讼公正抑或诉讼效率层面探究皆不能得到移植我国的适用的证据。

| Abstract: | As a procedural lawsuit for fast termination of judicial cases, plea-bargaining system originated from the United States with its immanent rationality.In order to implant the system into China's criminal procedural law with criticized viewpoints ,we should adopt strict procedural rules to guarantee the correction and normalization of implementation.The viewpoint of introducing plea bargain on crimination should not be supported whether we care for impartiality or efficiency. |
