| 摘 要： | 市场失灵假设是研究经济法产生、调整对象、体系等问题的一个重要的前提。中国的市场失灵问题必须结合中国由计划经济体制向市场经济体制转轨这个过渡期的大的现实背景来理解,以西方经济学的市场失灵假设为基础来构建中国经济法并不完全适合。中国经济法必须立足于转轨时期的现实国情,才能走出一条务实之路。

| Abstract: | As the premise of economic law theory,market failure in China are different from that in west countries,so it is incorrect to structure economic law in China with west economic theories.Market failure in China must be understood under the lackground from planned eronwnic system to market economic system.Only based on situation and condition in transitional age,economic law in China can become more pragmatic. |
