| 摘 要： | 国家法本身具有一定的缺陷 ,而当国家法向农村社会渗透和延伸的时候 ,从制度设计和文化发展的视角和层面看 ,国家法的缺陷更加明显 ,而这种缺陷的存在又为民间法的发展留下了制度空间 ,为民间法与国家法的互动提供了可能和条件。
