| 摘 要： | 侦查动态性是指侦查机关采取专门的调查工作和强制措施,使案件中的相关人、物(证据)和事等各个犯罪要素从绝对运动、未知到相对静止、已知的活动及其过程,可以分为侦查言词动态和侦查技术动态两类。侦查动态性是侦查与权利保障和法律约束性相互矛盾的根本原因之一,应该从侦查动态性本身、权利保障和法律约束性入手对其进行完善发展。

| Abstract: | Investigating dynamics means that investigation organs to take the special investigation and compulsory measures make relevant people, things with each crime key elements etc. in the case (evidence) from absolute movement and undiscovered to relatively static and known course, which can be divided into two kinds of investigating dynamics of words and technology. Investigating dynamics is one of the basic reasons that investigation with the right guarantee and legal binding character are contradictory each other, should perfect and develop it starting with investigating dynamics, the right guarantee and legal binding character. |
