吸收犯概念及其性质辨析

吸收犯,是指出于数个不同的犯罪故意,实施数个不同的犯罪行为,侵犯数个不同的法益,触犯数个不同的罪名,具备数个独立的犯罪构成,本应成立数罪,但由于数行为之间的相对独立性,故在处理时仅作为一罪的情况。作为处断上的一罪,吸收犯以行为要素上的复数性、罪名要素上的相异性和数行为关系要素上的相对独立性为其本质属性。

On the Concept and Nature of an Absorbable Offense

An absorbable offense is that a person commits plural crimes, on different plural criminal intents, different plural actus reus, infringing upon different legal interests, conforming different plural constitutions of crimes, and should be considered one crime judicially as the relative independence of the actus reus. It is the nature that an absorbable offense has plural actus reus, different accusations and relative independence of the actus reus.
