| 摘 要： | 在当前我国刑事立法和司法中都不存在严格责任,而且将来也不应采用严格责任。罪过责任始终是我国刑事责任的原则,严格责任与我国刑法的性质格格不入,应予否定。

| Abstract: | There is no strict responsibility in either the criminal legislation or judicature in our country at present, and it should not be adopted in the future. The responsibility of guilt is the principle of criminal responsibility in our country from the beginning to the end. Not compatible with the nature of the criminal law of our country, strict responsibility should be denied. |
