| 摘 要： | 欧洲刑事政策研究的脉络呈现为四个阶段：报应主义阶段、实证主义阶段、目的主义阶段和人道主义阶段。这些内容反映出了动态发展过程中的刑事政策特征,给了我们如下启示：不同语境下＂刑事政策＂这一术语表达了不同的含义;当今刑事政策学已脱离刑法学与犯罪学而成为一门独立学科并具有相当明显的学科属性及特点。因此应统一全球语境下的刑事政策及刑事政策学。

| Abstract: | The developing history of criminal policy in Europe can be divided into four stages which reflect the features of criminal policy in its dynamic development.The following enlightenment can be gained.Criminal policy has different meanings in different contexts.In modern times,criminal policy has separated from criminal law and criminology and become an independent branch of learning which has its own disciplinary attributes.Criminal policy and criminal policy science should be unified in the global context. |
