| 摘 要： | 生态补偿制度是解决油气资源开发利用中生态利益和经济利益的冲突,协调利益相关者之间关系的有效机制。本文以庆阳市为例,探讨了油气资源开发对庆阳水资源、土地资源等生态环境和居民身体健康的影响,并以此为基础分析了油气资源开发生态补偿的法律原则。油气资源生态补偿必须贯彻污染者和受益者补偿原则、区分新旧帐补偿原则及国家补偿和市场补偿相结合原则,促进补偿资金来源的多渠道和多样化,才能实现油气资源生态补偿的预期目的。

| Abstract: | Eco-compensation system is an effective mechanism to solve the oil-gas exploitation in ecological and economic interests in the conflict,coordinate the relationship between the stakeholders.This paper takes Qingyang city as an example and discusses impact of the oil-gas exploitation on the water and land resources ecology environment and residents health.Based on this,the paper analysis legal principle of eco-compensation of oil-gas exploitation.There are polluters and the beneficiaries compensation principle,distinguish between new wipe compensation principle and combination of national and market compensation principles,which can not only promotes compensation funding sources of multi-channel and diversification but also achieve the purpose of eco-compensation of oil-gas exploitation. |
