关于国家赔偿标准的问题与建议

《国家赔偿法》规定的赔偿标准是一个与民事赔偿标准不同的低赔偿标准,在8年的实践中暴露出诸多缺陷。当初确定低标准的认识,现在看来是不正确的。国家赔偿的标准,应当在总体上高于民事赔偿标准,应当坚持完全赔偿原则、充分实现赔偿功能的原则、以人为本原则和公平原则。建议在国家赔偿标准方面进行修改:一是扩大赔偿范围;二是取消最高幅度限制;三是应赔偿全部直接损失和合理的间接损失;四是增加精神损害赔偿;五是增加惩罚性赔偿;六是提高人身损害的赔偿标准;七是财产市值计算要有利于受害人。

Questions and Proposals on the Criteria of National Compensation

To coordinate national compensation with civil damages, to resolve the hard problem of the amount of money of national compensation is less than civil damages, this article thinks that the following principles should be focused on: principle of complete compensation, principle of realizing the function of compensation wholly, principle of human being oriented. The following proposals should be focused on: firstly, to extent compensation scope; secondly, to abolish the limit of the most amount; thirdly, to complete direct damages and reasonable indirect damages; forth, to add to mental damages and punitive damages; lastly, to raise the amount of compensation for personal injury.
