两岸投资保障协议中争端解决条款的困境及其出路

争议解决条款是困扰两岸投资保障协议谈判的最重要的因素之一。争议解决机制的选择上的困境，不但体现在现行的国家之间的投资条约中的投资争议解决模式无法为两岸投资保障协议提供范式，而且体现在现行国内立法上的局限上。可行的途径是在区分不同主体之间的投资争端的基础上，寻求不同的解决方式。本文强烈建议充分发挥两岸经济合作框架协议设立的经济合作委员会的作用来解决相关投资争端，同时避免以政治化的方式利用现行的仲裁争端解决方式。

The Predicament of Dispute Settlement Clause in Cross-Strait Investment Agreement and its Outlet

The dispute settlement clause is the leading obstacle to an earlier conclusion of the proposed cross-strait investment agreement.The predicament relating to the selection of appropriate mechanism for dispute settlement is not only reflective of the fact that the existing investment agreements between states are unable to offer a viable model for the dispute settlement clause in the cross-strait investment agreement,but of the fact the choice is constrained by the existing domestic legal framework.An advisable way is to differentiate various investment disputes in light of the disputants and seek corresponding mechanisms for dispute settlement.It is highly recommended the Cross-Strait Economic Cooperation Committee,which is built in the ECFA,is given its due role in settling investment disputes between the authorities across the Taiwan Straits and those between the authority on one side and the investor on the other side.Politicization shall be refrained in approaching arbitration for settlement of investment disputes.
