吉林省涉黑犯罪调查及其思考

当前吉林省黑社会性质组织多为中等规模,成员以无业人员、刑释解教人员和进城农民为主,"村霸"型、"垄断特定行业"型、"商黑一体化"型、"经营地下行业"型、"官黑一体化"型和"恶霸"型组织是其主要类型,黑恶势力向经济领域、农村基层政权或政治领域渗透的趋势日益突出,已影响到基层政权的稳定。其主要原因在于经济发展过程中社会发展滞后和社会管理不到位,所以应根据当前黑社会性质组织暴力性特征弱化而经济特征和非法控制特征强化的发展趋势,对刑法关于黑社会性质组织的认定标准作适当调整;同时,对黑社会性质组织的组织行为、领导行为、积极参加及其他参加行为作出明确的界定,以有效规制其犯罪行为。

An Investigation ,into the Crimes Related to Gangland in Jilin Province

Currently organizations with characteristics of gangland in Jilin province are mainly of medium-size.The members of such an organization include jobless persons,persons of terminated imprisonment or rehabilitation,farmers migrating to cities and village tyrants.That kind of crime mainly include trade monopoly,integration of legal business and gangland crimes,underground trades,integration of officials and gangland and tyrant-like businesses.There is an increasing trend of gangland-like organizations infiltrating into local governments and the political fields,which has affected the stability of local governments.Owing to the imbalance of social development and poor social management,gangland-like organizations display more economic features than violent ones.Therefore,the criteria by which to determine gangland organizations should be adjusted in the criminal law.Meanwhile,aspects such as the organizing,leading and participating in a gangland-like organization should be clearly defined to effectively regulate such a crime.
