论管制刑的适用与完善

管制刑是主刑中最轻的刑种,它是针对犯罪较轻、认罪态度较好并且不需要关押的犯罪分子而专门设计的。由于没有规定违反管制刑的后果或处置措施,管制刑没有足够的约束力和严肃性,从而导致管制刑被虚置的情况发生。管制刑不应被废除而应予以保留。为了使管制刑能够发挥应有的作用,应从管制刑的内容、执行程序上进行修改、完善。
