A Research on the Characteristics of Judicial Activism of the Chinese Style——From the perspective of the Comparasion betwween China and USA

Judicial activism of the Chinese-style typified by the longxian judicial activism of the eight-four model in Shannxi province,has got its own unique characteristics in the problem consciousness,judicial subject,judicial nature and the functions of the Supreme Court,compared with the United States.The comparative study on judicial activism between the Chinese and the USA help us understand the unique Chinese judicial practice and grasp the unique problems and the basic tendency of Chinese judicial reform.
