| 摘 要： | 电脑量刑是一种新型的量刑辅助工具,其本质是辅助法官进行查询,并作出有效判断。由于其程序或系统设定得还不够完善,法律应赋予其相应的主体地位,使其充分发挥量刑规范化、公平公正的作用。
