人权入宪与劳动教养

我国现行的劳动教养执法存在许多缺陷,与维护社会治安秩序的需要不相适应。我国人权入宪将对劳动教养制度产生重要影响,并将推动我国劳动教养制度改革。人权入宪与劳动教养是辩证统一的关系,它们相互依赖,相互保障。改革劳动教养制度,必须在端正执法思想,更新执法观念等方面着力。

The human rights of our country are stipulated in the constitution exerts an important influence on the system of the reeducation through labor, which plays an important push role to the system reform. It helps to upgrade the legislative idea, carries forward human rights spirit, accelerate the legislative process of the reeducation through labor; reform the mechanism of enforcing the law.
