公私法交织中的不动产登记

摘    要:不动产登记制度体现了公权力对私权利的介入和渗透,不动产登记行为是具有私法效果的行政行为,既具备行政行为的各项要素和效力内容,又有明确的"界定产权,便利交易"的私权效用。为切实体现不动产登记制度的私权保障功能,对有关公权力的行使应予以限制。登记机构因错误登记产生的赔偿责任虽是行政责任,但又常常与当事人之间的民事责任相交织,导致赔偿请求人资格、因果关系、责任的划分、求偿程序等问题错综复杂。在具体的制度安排上,真权利人和善意第三人均可以成为赔偿请求人;应采用相当因果关系理论分析错误登记行为与当事人损害间的因果关系;在混合侵权场合,司法求偿时不能适用行政附带民事诉讼,只能分别进行两种诉讼方式,并由登记机构承担补充赔偿责任。
